How to Change the Plaintiff in a Legal Case

Notice of Change of Plaintiff (Υποκατάσταση Διαδίκου)
This is the recommended procedure when one plaintiff is replaced by another, while the lawsuit is in progress and both plaintiffs (old and new) are your clients.

Connect the new plaintiff to the Legal Case

  1. Go to the Legal Case

  2. In the Case Parties table click + Client button

  3. Enter the new plaintiff details and then click Add.

Create the Action “Οδηγίες Πελάτη για Αλλαγή Ενάγοντα”

  1. Go to the Legal Case

  2. Click on the + Action button and select the action “Οδηγίες Πελάτη για Αλλαγή Ενάγοντα”

  3. Ιn the New Action window, complete the following information:

    1. Due Date: The instructions date

    2. Action Lawyers: The Lawyers responsible for the change

    3. Origin: To our Office

    4. Involved Parties: Select the client that gave the instructions

    5. If you do not want to upload the Instructions Letter of the client, click on the Create & Complete button.

    6. If you want to upload the Instructions Letter then:

      1. Click on the Create button

      2. Upload the Instructions Letter

      3. Click on the Complete Action button

      4. Enter in the Completion Date field the instructions date and click the Mark as Complete button.

Create the Action “Καταχώριση Ειδοποίησης Αλλαγής Ονόματος Εναγόντων”

  1. Go to the Legal Case

  2. Click on the + Action button and select the action “Καταχώριση Ειδοποίησης Αλλαγής Ονόματος Εναγόντων”

  3. Ιn the New Action window, complete the following information:

    1. Due Date: The Expected filing date of the notice

    2. Action Lawyers: The Lawyers responsible for the notice

    3. Origin: From our Office

    4. Involved Parties: Select both the “Old Plaintiff” and the “New Plaintiff”

    5. Click on the Create button

  4. Upload the Notice file in the Documents table

  5. Click on the Complete Action button

  6. In the Completion Date field, enter the filing date of the notice

  7. Finally, click on the Mark as Complete button.

Change the Case Party Status of the “Old Plaintiff” to Inactive

  1. Go to the Legal Case

  2. In the Case Parties table, locate the Old Plaintiff, then click on the menu icon (three vertical-dots) and click Mark as Inactive

  3. In the Inactivation Date field, enter the filing date of the notice

  4. In the Inactivation Reason (optional) you can select the reason “Υποκατάσταση”

  5. Finally, click on the Continue button

Correct the Legal Case Short Title by replacing the Name of the “Old Plaintiff” with that of the “New Plaintiff”

  1. Go to the Legal Case

  2. Click on the Tools button and then Edit Case Header

  3. Correct the Short Title field by replacing the name of the “Old Plaintiff” with that of the “New Plaintiff”

  4. Click on the Save button

Correct the Legal Case Official Title

  1. Go to the Legal Case, Details tab

  2. Edit the Legal Case Title, by pressing the pencil icon

  3. Click on the Load Case Parties button

  4. In the Case Parties table, select the name of the “New Plaintiff” and then click on the Append button

  5. Correct the Title by removing the details of the “Old Plaintiff” and moving the new text to the proper position.

  6. Once you are done, click on the Save button.

Correct the Involved Parties in Future Actions by replacing the “Old Plaintiff” with the “New Plaintiff”

  1. Go to the Legal Case, Actions tab

  2. For each pending future action, that needs correction

    1. Click on the Action Title to navigate to the action

    2. In the Involved Parties table,

      1. Click on the + Involved Party button, select the “New Plaintiff” and click the Add button

      2. Locate the “Old Plaintiff” and using the menu icon (three vertical-dots), click on the Remove Involved Party.
